Trademark Registration in the UAE: Process, Costs, and Timeline

Why Register a Trademark in the UAE

A registered trademark gives you exclusive rights to use your brand name, logo, or slogan in the UAE for the goods or services you register it under. Without registration, you have very limited legal recourse if someone copies your brand.

The UAE follows a first-to-file system, not first-to-use. This means the first person to register a trademark owns it, regardless of who used it first in the market. We have seen cases where businesses operated in the UAE for years without registration, only to find that someone else registered their brand name. Recovering from that situation is expensive and time-consuming.

Trademark registration in the UAE covers all seven emirates. You do not need to register separately in Dubai, Abu Dhabi, or any other emirate — one registration covers the entire country. However, a UAE registration does not automatically protect your brand in other GCC countries. If you operate regionally, consider filing in each country or using the Madrid Protocol for international registration.

The UAE is a member of the Paris Convention and the Madrid Protocol, which means you can use your UAE filing as a basis for international trademark applications. This is useful for businesses planning to expand beyond the UAE market.

The Trademark Registration Process

Step 1: Trademark search. Before filing, conduct a search to check if your proposed trademark conflicts with existing registrations. The Ministry of Economy maintains the trademark database. You can conduct a preliminary search online through the WIPO Global Brand Database or hire a trademark agent to conduct a comprehensive search. Cost: AED 0 for online self-search, AED 500-2,000 for professional search.

Step 2: Prepare your application. You need to determine which Nice Classification classes your trademark falls under. There are 45 classes covering different types of goods and services. For example, Class 35 covers advertising and business management, Class 42 covers technology services, and Class 25 covers clothing. Each class requires a separate application and fee.

Step 3: File the application. Applications are filed through the Ministry of Economy or through authorized trademark agents. Required documents include: the trademark (word mark or logo), applicant details, list of goods/services in each class, power of attorney if filing through an agent, and the priority document if claiming convention priority.

Step 4: Examination. The Ministry examines your application for conflicts with existing trademarks and compliance with UAE trademark law. This takes approximately 2-4 months. If objections are raised, you have 30 days to respond.

Step 5: Publication. If the application passes examination, it is published in two local newspapers (one Arabic, one English) for opposition purposes. The publication period is 30 days, during which any third party can oppose your registration. Publication costs approximately AED 3,000-5,000.

Step 6: Registration. If no opposition is filed (or if opposition is resolved in your favor), the trademark is registered and a certificate is issued. Total timeline from filing to registration is typically 6-12 months.

Costs Breakdown

Trademark registration costs in the UAE involve multiple government and professional fees:

Government fees (per class):

  • Application filing fee: approximately AED 500-1,000
  • Examination fee: included in filing or AED 500 separately
  • Publication fee: AED 3,000-5,000 (two newspapers)
  • Registration certificate fee: approximately AED 500-1,000

Professional fees:

  • Trademark agent fees: AED 3,000-8,000 per class (for preparing and managing the application)
  • Trademark search: AED 500-2,000
  • Power of attorney notarization: AED 200-500

Total cost per class: AED 7,000-15,000 depending on whether you use a professional agent and the complexity of your application.

Most businesses file in 1-3 classes. A technology consultancy might file in Class 35 (business services) and Class 42 (technology services). A consumer brand might file in their product class plus Class 35 (retail services).

Renewal: UAE trademarks are valid for 10 years from the filing date and can be renewed indefinitely in 10-year periods. Renewal fees are approximately AED 5,000-8,000 per class including agent fees.

Common Pitfalls and How to Avoid Them

Filing in the wrong classes. If you register in Class 35 (business services) but your main product is software (Class 42), your registration does not protect your core offering. Work with a trademark agent or use the Nice Classification guide to identify all relevant classes.

Using generic or descriptive terms. Trademarks must be distinctive. A name like "Dubai IT Solutions" is unlikely to be accepted because it describes the service and location rather than identifying a unique source. Invented words, arbitrary names, or suggestive marks have the strongest protection.

Ignoring Arabic translation. In the UAE, trademarks in English should also be registered in their Arabic transliteration. If you do not register the Arabic version, someone else could register a confusingly similar Arabic mark. Many agents recommend filing both versions simultaneously.

Not monitoring after registration. Registration is not the end — you need to monitor the market for infringement and the trademark register for conflicting new applications. Set up a watching service through your trademark agent to receive alerts when similar marks are filed.

Letting registration lapse. If you do not renew within the grace period after 10 years, your trademark is cancelled. Set a reminder at least 6 months before expiry. Also, if you do not use the trademark for 5 consecutive years, it can be cancelled for non-use by a third party.

Frequently Asked Questions

How long does trademark registration take in the UAE?

The typical timeline from filing to registration is 6-12 months. This includes examination (2-4 months), publication (30 days), and processing of the registration certificate. Delays can occur if objections are raised during examination or if opposition is filed during the publication period.

How much does it cost to register a trademark in the UAE?

Total cost is approximately AED 7,000-15,000 per class, including government fees and professional agent fees. Government fees alone are approximately AED 4,000-7,000 per class. Most businesses file in 1-3 classes. Using a professional trademark agent adds to the cost but significantly reduces the risk of errors and objections.

Does a UAE trademark protect my brand in other GCC countries?

No. A UAE trademark registration only covers the seven emirates of the UAE. For protection in Saudi Arabia, Bahrain, Kuwait, Oman, or Qatar, you need separate registrations in each country. The Madrid Protocol allows you to file international applications using your UAE registration as a basis.
